General Terms and Conditions of Sale

These General Terms and Conditions of Sale (“Terms”) govern all sales made on the website www.berthie.com by the brand Berthie.

Any order placed implies full and unconditional acceptance of these Terms.

1 — Seller

Products are sold by:

BERTHIE

2 — Products

The products offered for sale are ready-to-wear clothing and accessories.

Each product is presented with the most accurate description possible.
Minor variations may occur (materials, colors, artisanal finishes).

As part of Berthie’s new organization:
👉 certain pieces are produced to order or on pre-order
👉 estimated production and delivery times are indicated on each product page.

3 — Prices

Prices are displayed in:

  • € / applicable currency
  • all taxes included (VAT included)
  • excluding shipping costs

Shipping costs are displayed before order confirmation.

Berthie reserves the right to modify prices at any time.
The price applied is the one displayed at the time the order is placed.

4 — Orders

An order is considered confirmed when:

  • payment has been accepted

  • the customer receives an order confirmation email

Berthie reserves the right to refuse any order in the event of:

  • suspected fraud
  • an unresolved previous dispute
  • payment refusal

5 — Payment

Payment is secured via:

Shopify Payments

Berthie never has access to full credit card details.

Payment is due immediately at the time of order.

6 — Production & Delivery Times

Berthie operates with:

  • limited production
  • pre-orders

  • made-to-order production depending on the item

Estimated timelines are specified on each product page.

⚠️ These timelines are indicative; however, Berthie commits to informing customers in the event of any delay.

Shipping is carried out via:
COLISSIMO

7 — Delivery

Products are delivered to the address provided by the customer.

Berthie cannot be held responsible for:

  • incorrect address provided by the customer
  • delays caused by the carrier
  • loss of a parcel after proof of delivery

If a parcel is not received, the customer must contact customer service within 7 days.

8 — Right of Withdrawal

In accordance with consumer law:

The customer has 14 days from receipt of the order to exercise their right of withdrawal.

Conditions for return:

  • product not worn
  •  not washed
  • with original tags

  • in original packaging

Returns must be sent to:

Return shipping costs are borne by the customer for orders under €200.

9 — Exceptions to the Right of Withdrawal

The following items are non-refundable:

  • personalized items
  • made-to-measure items

  • products modified at the customer’s request

10 — Refunds

Refunds are issued within:

  • [7–14 days] after receipt of a compliant return

Refunds are made using the original payment method.

11 — Exchanges

To exchange a product, the customer must return the item and place a new order.

12 — Legal Warranties

Products benefit from:

  • the legal guarantee of conformity

  • the warranty against hidden defects

In the event of a defect, the customer must contact customer service with supporting photos.

13 — Liability

Berthie shall not be held liable for:

  • improper use of the product
  • normal wear and tear
  • damage caused by non-compliant washing or care

14 — Intellectual Property

All content on the website, including:

  • texts 
  • photographs
  • logos
  • designs

is the exclusive property of Berthie.
Any reproduction is strictly prohibited.

15 — Personal Data

Personal data is processed in accordance with the Privacy Policy available on the website.

16 — Governing Law

These Terms are governed by French law.

In the event of a dispute, an amicable resolution will be sought before any legal action.
